Uniform Gift/Transfer to Minor

The Uniform Gifts to Minors Act (UGMA) allows assets to be held in a custodian's name for the benefit of a minor.  The Uniform Transfers to Minors Act (UTMA) expands the scope of the Uniform Gifts to Minors Act.  Most states have adopted the Uniform Transfers to Minors Act, which replaces the Uniform Gifts to Minors Act. When you open the account, we will register it under whichever act is effective in the state of residence of the donor/grantor, custodian or minor.  The enacting state may be the donor's, custodian's, or minor's state of residence. Once established, the enacting state stays the same regardless of change of address.

There may be only one custodian and one minor per account.  The funds legally belong to the minor and the account must use the minor's Social Security Number; however, the custodian will exercise the powers and duties of the minor until the minor reaches the age of majority.  The assets invested must be used for the benefit of the minor.
